Services TERMS AND CONDITIONS

Conditions

1.KCCS has been nominated by the Customer to provide cleaning services for the cleaning of the Customer’s premises, as stated in the Quote. Any other  areas shall be subject to separate contracts between the Customer and the KCCS.

2.KCCS may be required by the Customer to carry out initial cleaning for the Buildings upon commencement of the term if deemed necessary. This would only be applied after discussion with the Business Manager.

3.In the event of emergency, KCCS shall provide cleaners to carry out any necessary works, if requested by the Business Manager.  Such works may include work to the Building surroundings.  Payment shall be made in accordance with the unit rates quoted in the quotation document.

4.In addition to the routine works specified, KCCS may be required to carry out extra cleaning works from time to time, if requested by the Business Manager.  Additional payments will be made by the Customer. 

5.Any additional service charge quoted by KCCS in the quotation document shall not form part of the contract, but such charges shall be valid whenever the Customer wish to employ relevant services during the term if required by the Business Manager.

6.KCCS shall be responsible for the efficient performance of the contract and for the good conduct of its employees whenever they carry out cleaning works in the buildings.  KCCS shall maintain a sufficient number of cleaning operative at all specific times to properly fulfil its obligations under this contract. KCCS employees shall be properly supervised by a supervisor employed for this purpose by the company.  KCCS shall provide clean and tidy uniforms for all employees.  The uniform must be worn by all employees who are engaged to carry out the works under the contract.

 7.KCCS shall provide high quality cleaning operatives for the buildings at all times as follows:

8.The area supervisor, who has sound knowledge and experience in Area supervision of cleaning operations for high quality buildings, shall be the person in charge of daily operations of the cleaning team and responsible for reporting to the Customer.  This person shall have strong supervisory and communication skills, initiative, enthusiasm and shall be reliable.  The supervisor is also available to perform his/her duties outside normal working hours at KCCS

9.All KCCS cleaners shall be observant, keen, alert, efficient, willing and pleasant.  Adequate training shall be provided to all cleaning staff to guarantee a high cleaning standard.

10.KCCS shall provide only chemical substances which satisfies the COSHH regulation and necessary tools and materials (Excluding Machinery) for the proper execution of the work.  Such materials shall be of a high standard and suitable for the use in the Buildings.

11.Unless written consent is given by the Customer, KCCS or any part, share, or interest in it, will not be transferred or assigned by KCCS, directly or indirectly, to any persons whomsoever.

12.KCCS employees must observe all reasonable instructions from the Customer to maintain high security standard and business values.

13.KCCS, only with the Customer’s prior agreement shall vary the work reasonably described in the specifications and tender documentation and no reasonable variation shall void the applicable contract.  Should more or less work need to be carried out by KCCS this is to be discussed with the Business Manager before proceeding. Such changes will then be, after deliberation added to or deducted from the contract sum at the rates set out in the Quotation documentation.

14.Whenever under this contract any sum of money shall be recoverable from or payable by the customer, the same may be added to any sum due or which at any time thereafter may become due to KCCS under applicable contract.

15.Claims

15.1 KCCS public liability insurance will cover damages caused by a cleaning operative working on behalf of the Company. All claims are subject to an excess of £250.00 to be paid by the Customer.

15.2 The Customer agrees that due to the nature of the service KCCS guarantees only to correct any problems reported within 24 hours of the completion of the service. If a problem occurs on a Friday or Saturday it must be reported by Monday 17:30 in order to be accepted as a valid claim. Failure to do so will entitle the Customer to no compensation.KCCS may require entry to the location of the claim within 24 hours to correct the problem.

15.3  While KCCS Operatives make every effort not to break items, accidents do happen. Identical replacement is always attempted but not guaranteed. KCCS requests that all irreplaceable items (whether monetarily or sentimentally valuable) be stored away. The Customer will advise the staff of this request.      

15.4  In case of damage, KCCS will repair the item at its cost. If the item cannot be repaired the Company will rectify the problem by crediting the customer with the item's replacement value from KCCS source upon payment of cleaning services rendered. 

16. LIABILITY :KCCS shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the customer arising from or in any way connected with: 

16.1    Its failure to carry out its services as a result of factors that are beyond its control.  Factors being acts of god, floods, severe weather conditions, inability to gain access to premises, lack of appropriate resources, such as water, electricity and lighting;

16.2    KCCS employees shall be punctual at their work location.  If transport related and other problems which are beyond the employee’s control occur, KCCS operative’s may arrive with a slight delay.  However, the Customer shall be advised as soon as possible if any such situation has arisen and what measures are being put in place.  Should an KCCS operative ring in sick the Customer shall be advised by midday of that day and again advised regarding the replacement.   

16.3    Any existing damage to Customer property in the form of old stains/burns/spillages etc which cannot be cleaned/removed completely by the cleaning operative using the industry standard cleaning methods;

16.4    Non satisfactory result from the service due to the Customer or third party walking on the area during or shortly after the cleaning process;

16.5    KCCS shall not be liable for the shrinkage of carpets as a result of natural fibre carpets being wet cleaned.KCCS shall ensure that the Customer’s authority is verbally informed of this and a written confirmation prior to proceeding with the service will be required; any issues arising subsequently shall be the sole responsibility of the Customer.  The Customer will advise KCCS of any natural fibre carpets within the premises to ensure that they are aware and can act accordingly.

16.6   KCCS shall not be liable for the shrinkage of carpets as a result of poor fitting.

16.7   KCCS shall not be liable for carpets expanding or ripples forming during and/or after the cleaning when this is as a result of factors such as fibre content, wear and tear, weak backing and/or poor fitting.

16.8   KCCS shall not be responsible for a poor result in cleaning where this is a result of considerable wear and tear and/or staining to the carpet fibres or vinyl damaged prior to the service being carried out.

16.9   KCCS shall not be liable for any odours arising during and/or after cleaning when this is due to factors such as, lack of ventilation, and/or appropriate heating.

16.10 KCCS shall not be responsible for any damage caused as a result of the Customer placing furniture on a carpet or moving item on a reconditioned floor which has not completely dried. 

16.11 KCCS may record all incoming and outgoing phone conversations for quality control, record keeping and back-referral for any inquiries or investigations.

16.12 KCCS shall be liable for any damages due to negligence on the operatives part;

 17. SUPPLEMENTARY TERMS :

 17.1     If the Customer requests keys to be collected by KCCS operatives from an address outside the postal code of the Customer address then a £45.00 charge will apply. The charge will cover only the pickup of keys. If the said keys need to be returned back to the pickup address or any other address another charge of £45.00 will apply.

17.2    If any estimates of how long it will take the cleaning operatives to do any additional job required are being provided that is only an estimate based on the average time it takes to clean a similar area, or measurement or an office of similar size to the business, it is difficult to estimate precisely how long such tasks may take and a degree of flexibility may be required.

17.3    The Customer understands that the price KCCS has quoted is not for a "package deal" and does not include anything apart from  service/s stated, as applied to the accepted quotation for cleaning.

17.4    The quotation excludes the clearing of debris created by tradesman or building work unless otherwise stated.          

17.5    KCCS cleaners are happy to move furniture. Due to Health and Safety regulations the cleaner will attempt to move only furniture that requires no more than one person.

17.6   KCCS shall arrange an immediate replacement in the event an operative cannot attend a work and will inform the Customer prior to attendance.

17.7    All fragile and highly breakable items must be secured or removed at all times where possible.

17.8     The provisions of this contract are not intended to confer any benefit upon Third parties and the provisions of the Contracts (Rights of Third Parties) Act 1999, are hereby expressly excluded from this agreement.

18.   OUR GUARANTEE

18.KCCS has built its business and reputation by providing its customers with the best possible cleaning service available. Still, we realise that sometimes mistakes occur. For this reason, KCCS offers you a guarantee. If the Customer is not satisfied with the company’s service for any reason, our operatives will ensure that the Customer’s premise/s are re-cleaned to the Customer’s complete satisfaction at no extra cost to the Customer.

18.2Our guarantee is subject to a complaints notice no later than 24 hours after the completion of the day’s cleaning operations

18.3    The specific methods and materials to be employed by KCCS for cleaning the buildings shall be designed to ensure cleaning standards are of the highest quality.

18.KCCS will comply with all Environmental and Health and safety Legislation, paying particular attention to the health and safety of the users, visitors and workers in the buildings.
